1. Acceptance of Terms

By engaging Acecooling for any services, you affirm that you are of legal age and have the capacity to enter into this agreement. If you do not agree with any part of these Terms, you must not use or procure our services.

2. Services Provided

Acecooling specializes in providing high-quality HVAC, cooling, and refrigeration installation, maintenance, repair, and related consulting services.

  • Quotations: All service quotations are valid for a period of 30 calendar days unless otherwise stated in writing. Acecooling reserves the right to withdraw a quote if external costs change significantly.
  • Scheduling: Service dates and times are estimates and may be subject to change due to unforeseen circumstances (e.g., extreme weather, equipment delays). We will make reasonable efforts to inform you of any changes promptly.
  • Access: You are responsible for ensuring clear, safe, and lawful access to the premises and equipment necessary for Acecooling to perform the services.

3. Client Obligations

The client (referred to as "you" or "your") agrees to:

  • Provide accurate and complete information regarding the site, the existing equipment, and the nature of the issue or requirement.
  • Secure all necessary permits, licenses, or approvals required for the service work to be performed at the location.
  • Ensure a safe working environment for Acecooling personnel.
  • Adhere to the payment schedule as detailed in Section 4.

4. Payment and Billing

  • Invoicing: Invoices will be issued upon completion of the service or according to the payment milestones agreed upon for larger projects.
  • Payment Terms: Unless a separate contract or quotation specifies different terms, payment is due within 7 days of the invoice date.
  • Non-Payment: Acecooling reserves the right to charge interest on overdue amounts at the maximum rate permitted by South African law. We may also suspend or terminate any future services until the outstanding amount is settled.

5. Warranties and Disclaimers

  • Service Warranty: Acecooling warrants that all services will be performed in a professional and workmanlike manner. Any defects arising directly from the workmanship must be reported within 90 days of service completion.
  • Equipment Warranty: New equipment installed by Acecooling is subject to the original manufacturer’s warranty. We do not provide a separate warranty for the equipment itself, only for the installation service.
  • Disclaimer: Except for the express warranties set forth above, Acecooling provides its services on an "as-is" and "as-available" basis. We disclaim all other warranties, express or implied.

6. Limitation of Liability

Acecooling shall not be liable for any indirect, incidental, special, consequential, or punitive damages. In no event shall Acecooling's aggregate liability for all claims relating to the services exceed the amount you paid to Acecooling for the specific services in question over the three (3) month period preceding the claim.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Johannesburg, South Africa.

9. Changes to Terms

Acecooling reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes by updating the "Last Updated" date at the top of this document. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.
